Agreement
These Terms of Use ("Terms") govern your access to and use of Lume (the "App"), provided by the developer at alex@pulsedo.app ("we", "us", or "our"). Please read them carefully.
1. Eligibility
You must be at least 13 years old to use Lume. By using the App, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and Apple's App Store Terms of Service.
You may not:
- Copy, modify, or create derivative works of the App or its content.
- Reverse-engineer, decompile, or disassemble the App.
- Use the App for any commercial purpose without our written consent.
- Transfer or sublicense your rights under these Terms to any third party.
3. Your Content
You retain ownership of all photos and images you submit to the App ("Your Content"). By using the App's AI transformation features, you grant us a limited, royalty-free license to process Your Content solely to provide the requested service (portrait transformation).
By sharing a result to the Community feed, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute that post within the App. You may delete any Community post at any time to revoke this license for that content.
You represent that:
- You own or have the right to submit the photos you use.
- Your content does not violate any third-party rights.
- Your content complies with Section 4 (Prohibited Conduct) below.
4. Prohibited Conduct
You agree not to use Lume to process, generate, or share content that:
- Contains nudity, sexually explicit material, or content involving minors.
- Depicts or promotes violence, self-harm, or harm to others.
- Harasses, threatens, or defames any person.
- Infringes any copyright, trademark, or other intellectual property right.
- Constitutes deepfakes or non-consensual image manipulation of real individuals.
- Violates any applicable law or regulation.
We reserve the right to remove content that violates these rules and to suspend or terminate accounts of users who repeatedly or egregiously violate them.
5. AI-Generated Content
Portrait transformations are produced by artificial intelligence and may not always yield accurate or expected results. We do not guarantee the quality, accuracy, or artistic merit of AI-generated output. You use AI features at your own discretion.
You are solely responsible for how you use and share AI-generated portraits created from your photos.
6. Apple-Specific Terms
Lume is distributed through the Apple App Store. The following additional terms apply:
- These Terms are between you and us only — not with Apple, Inc.
- Apple has no obligation to provide any maintenance or support for the App.
- In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
7. Privacy
Our Privacy Policy describes how we collect, use, and protect your information. By using the App, you also agree to the Privacy Policy.
8. Intellectual Property
All aspects of the Lume App — including the name, design, code, graphics, and original content — are owned by us or our licensors and protected by applicable intellectual property laws. Nothing in these Terms transfers any IP rights to you.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR CONTINUOUSLY AVAILABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Termination
We may suspend or terminate your access to Lume at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your license to use the App ends immediately. Sections 3, 8, 9, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via an in-app notice or by updating the effective date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.
